Preparing For Employment Laws In 2025

Every year brings new laws, and we are following several that will go into effect in 2025. Here are a few of the biggest second chance laws that we’ll be watching.

Code Of Virginia

An update to the Code of Virginia will be made for Chapter 23.2, which is tilted Sealing of Criminal History Record Information and Court Records. This law creates automatic expungement opportunities for:
  • Certain non-violent misdemeanors.
  • Dismissed charges.
  • Misdemeanor marijuana violations.

Colorado’s Clean Slate Act

This Second Chance law initially went into effect in 2022 but will be expanded in 2025. An amendment to the Act decrees that eligible arrest records will be automatically sealed if no charges occurred within one year.

The Minnesota Clean Slate Act

This law will automate expungements for offenses that already qualify under the current expunction petition process. It will create a faster and more reliable method for residents to have criminal records expunged.

Qualifying records include:

  • Arrests where all charges were dismissed.
  • Non-violent records if the person completed the terms of a diversion program or stay of adjudication and has not been charged with another offense for one year.
  • Records that were adjudicated delinquent for, convicted of, or received a stayed sentence for a qualifying offense.

Washington, D.C.’s Second Chance Amendment Act

This law establishes automatic expungements for offenses that have since been legalized. Examples include marijuana possession and various other actions that are no longer deemed criminal acts. There will be phases to the expunction effort, and most misdemeanors will not be eligible until it has been ten years since the person's sentence was completed.

Other Potential Laws

As we enter the New Year, our team will be keeping an eye on other employment laws which cover various topics including:
  • Marijuana. Some of these laws could create restrictions for affected employers.
  • Artificial Intelligence. As AI technology continues to expand, we expect to see more bills that are intended to help prevent inadvertent discriminatory practices.
  • Screening Requirements. Some industries, particularly those that serve vulnerable populations, will likely have new requirements for stronger screening practices.
