A Study On Background Checks For Rideshare Drivers

The United States Government Accountability Office conducted a study on background checks for rideshare and taxi drivers.

Findings

The Government Accountability Office (GAO) conducted a study on safety and background checks for rideshare and taxi drivers. In a summary of their findings, they noted that 45 states and Washington D.C. require screenings for potential rideshare drivers. Only 10 states mandate them for taxi drivers, but the GAO further clarified that many city and local laws cover that scenario.

As part of their research, GAO representatives contacted five rideshare and five taxi companies. Each of the responders said they conduct background checks on all prospective drivers, regardless of whether they are required to do so by law.

Why The Study Was Conducted

The study occurred following the implementation of Sami’s Law in 2023, which requires the GOA to produce and submit a biennial report to Congress that includes the results of a study regarding:
  • The incidence of physical and sexual assault on drivers by passengers of ride-sharing vehicles and on passengers by drivers of such vehicles.
  • The nature of background checks conducted on prospective drivers of ride-sharing vehicles.
  • The safety steps that are taken by ride-sharing companies.

Background Checks For Drivers

The GAO also reviewed the types of background checks that are used for drivers. There are two primary types: fingerprint checks and screenings that are conducted by a Consumer Reporting Agency (CRA). As part of their study, they also documented the benefits and limitations of each one.

Fingerprint Checks

Pros:
  • Fingerprints provide an accurate identifier.
  • Most states use the same databases for fingerprint searches.
  • This option provides a nationwide database search.

Cons:
  • Data is often limited or missing from databases.
  • The process can take a long time, particularly if records are not complete.
  • This type of search requires a special authorization from the FBI, so it is not available to all employers.

CRA Reports

Pros:
  • CRAs provide timely results.
  • These background checks can contain records that are not available in FBI databases.
  • CRAs can use a combination of AI technology and highly trained employees to provide accurate, current data.
  • Any employer can use the services of a CRA.

Cons:
  • The processes CRAs use can vary greatly. That’s one big reason employers are always encouraged to work with one that is accredited by the Professional Background Screening Association (PBSA).
  • There can be a risk of false matches, especially with people who have common names. Again, this shows the importance of working with an accredited CRA that follows reasonable steps to provide accurate, current reports.

What These Findings Mean

Every organization the GAO contacted confirmed that they run background checks on all potential employees. This demonstrates the strong importance of screening everyone who might represent any business.
